Call to Order

Acting Chairman, Craig C. Fishbein, Esq. called the meeting to order at 12:00pm.

Chairman Fishbein called the roll call. 9 appellants were present and 1 failed to appear.

9 local Issuing Authorities were present, and 1 local Issuing Authority failed to appear.

Board Members Present: Chief T. William Knapp, (Ret.), Attorney Craig Fishbein, Attorney Jay Greer, Mr. Kenneth Tramadeo and Col. Kyle Overturf.

Board Members Absent: Joseph T. Corradino, Esq. and Mr. M. Peter Kuck

Chairman Fishbein administered the oath to all witnesses.

Hearings:

1) Case No. 13-102-D, Marc A. Baillargeon, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative was present for the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department.

Withdrawal: The appellant withdrew his appeal.

2) Case No. 13-361-D, Gregory Garofalo, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative failed to appear for the local Issuing Authority, Chief Michael Spera, Old Saybrook Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Michael Spera, Old Saybrook Police Department, by default for failure to appear, and voted for the appellant, Mr. Garofulo to be issued a temporary pistol permit.

3) Case No. 13-239-D, Alex J. Brescia, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative for the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department, failed to appear. 

Motion: Greer made a motion to dismiss the case due to both parties failing to appear. Tramadeo seconded the motion, motion carried.

4) Case No. 13-390-D, Robert Desantis, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative was present for the local Issuing Authority, Chief Christopher Edson, Naugatuck Police Department.

Withdrawal: The appellant withdrew his appeal.

5) Case No. 13-235-D, Kurt E. Wright, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative was present for the local Issuing Authority, Chief Edward L. Stephens, Wolcott Police Department.

Withdrawal: The appellant withdrew his appeal.

6) Case No. 13-336-D, Gregory McDaniel, Sr., involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Andrew Steinbrick represented the local Issuing Authority, Chief Robert J. Gagne, Orange Police Department.

Withdrawal: The appellant withdrew his appeal.

7) Case No. 13-248-D, Philip Beer, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Al Russo represented the local Issuing Authority, Chief Alan Baker, Danbury Police Department.

8) Case No. 13-231-D, Michael J. Giammarino, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative failed to appear for the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department, by default for failure to appear, and voted for the appellant, Mr. Giammarino to be issued a temporary pistol permit.

9) Case No. 13-242-D, Mark J. Shackford, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Patrick Buckley represented the local Issuing Authority, Chief Paul Melanson, Farmington Police Department with one witness.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Paul Melanson, Farmington Police Department, and voted for the appellant, Mr. Shackford to be issued a temporary pistol permit with the condition that Mr. Shackford submits his application and money orders within one week.

10) Case No. 13-390-D, Patrick J. Welsh, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Douglas Hoffman represented the local Issuing Authority, Chief Michael Crowley, Groton Town Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Michael Crowley, Groton Town Police Department, and voted for the appellant, Mr. Welsh to be issued a temporary pistol permit.
