BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Acting Chairman Craig C. Fishbein called the meeting to order at 12:00pm.

Fishbein called the roll call. 8 appellants were present and 1 appellant failed to appear.

The State Issuing Authority was present and 3 local Issuing Authorities were present.

Board Members Present: Chairman Joseph T. Corradino, Esq., Attorney Craig Fishbein, Attorney Jay Greer, Mr. M. Peter Kuck, Mr. Kenneth Tramadeo and Col. Kyle Overturf *(left due to an emergency at 1:30).

Board Members absent: Chief T. William Knapp, (Ret.)

Fishbein administered the oath to all witnesses.

Chairman Joseph T.  Corradino arrived at 12:10pm.

Hearings:

1) Case No.13-194-R, Anthony Maggi, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Agreement: A stipulated agreement between appellant and Sgt. D’Alessandro, representative of the State Issuing Authority. The appellant would withdraw his appeal and the State Issuing Authority agreed to reinstate the  pistol permit to Mr. Maggi on and not before August 16, 2013 and no later than August 31, 2013.

2) Case No. 13-193-R, Edward Legeyt, III, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

3) Case No. 13-164-D, Cebert Mitchell, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. The local Issuing Authority, Chief Tracy Gove, West Hartford Police Department, was present.

Motion: Chairman Corradino made a motion to strike 3 records from 2003 and 2011. Knapp seconded, motion carried.

Decision: By a unanimous decision, the Board voted to uphold the local Issuing Authority, Chief Gove’s decision to deny a temporary pistol permit, at this time.

4) Case No.13-158-R, Gian Fuschi, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Fuschi’s pistol permit.

5) Case No. 13-211-R, Rory Richardson, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Richardson’s permit, at this time.

6) Case No.13-036-R, Hopetown Howell, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Howell’s pistol permit, by default, due to the appellants’ failure to appear.

7) Case No. 13-178-D, Roger Lupoletti, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority representative from the Town of Stafford was present.

Dismissed: The Board voted to dismiss the appeal due to a felony conviction.

8) Case No. 13-233-D, Michael Palladino, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. James Kodzis, Mansfield Resident Trooper represents the local Issuing Authority.

Agreement: The appellant agreed to withdraw his appeal and the Sgt. Kodzis, local Issuing Authority, agreed to issue a permit by Aug. 30, 2013.

9) Case No. 13-237-R, Robert Merrill, Sr., involving the revocation of his pistol permit to carry pistols and revolvers. Attorney John A. Bond, Jr. represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

Secretary’s Report:
1) Tramadeo made a motion to approve the June 13, 2013 minutes, Kuck seconded the motion, motion carried.
