BOARD OF FIREARMS PERMIT EXAMINERS

Thursday January 24, 2013, 12:00pm at the

D.E.S.P.P, 1111 Country Club Road, Middletown, CT

Call to Order

Acting Chairman Craig C. Fishbein called the meeting to order at 12:00pm.

Acting Chairman Fishbein read the Introductory Statement

Acting Chairman Fishbein called the roll call.  8 appellants were present and  1 appellant was absent.

The State Issuing Authority was present and 5 local Issuing Authorities were present.

Board Members Present: Atty. Craig Fishbein, Chief T. William Knapp, (Ret.), Atty. Jay Greer and Col. Kyle Overturf

Board Members Absent: Attorney Joseph T. Corradino, Mr. M. Peter Kuck, and Mr. Kenneth Tramadeo

Acting Chairman Fishbein administered the oath to all witnesses.

Hearings:

1)Case No. 12-402-R, Timothy Levasseur, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Motion: Acting Chairman made a motion to continue the case to March 14, 2013, Knapp seconded the motion, motion carried.

2) Case No. 12-417-D, Michael Polito, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. First Selectmen John Hodge appeared as of the local Issuing from the Town of New Fairfield.

Decision: By a majority, the Board voted to uphold the revocation of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection. Fishbein voted for the appellant. Greer, Knapp and Overturf voted for the State Issuing Authority, at this time.

3) Case No. 13-054-D, Howard Haughton, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Crowley appeared for the local Issuing Authority, Chief Margaret Ackley, New London Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of denial from the local Issuing Authority, Chief Margaret Ackley, New London Police Department.

4) Case No. 12-239-R, Robert K. Julian, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman appeared on behalf of the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Agreement: The State Issuing Authority and the appellant agreed to withdraw the appeal and Mr. Julian will be issued a temporary pistol permit within 30 days.

5) Case No. 12-385-D, Ford Carr, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Tom Federowitz represented of the local Issuing Authority Chief Joe Hurliman, Shelton Police Department.

Agreement: The local Issuing Authority and the appellant agreed to withdraw the appeal and to issue the appellant a temporary pistol permit.

6) Case No. 12-166-D, Alfred Ranieri, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Sgt. Horman represented the local Issuing Authority Chief Kevin Halloran, Branford Police Department.

Agreement: The local Issuing Authority and the appellant agreed to withdraw the appeal and to issue the appellant a temporary pistol permit.

7) Case No. 13-074-D, Richard Lang, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative was present for the local Issuing Authority First Selectman Douglas E. Humes, Town of Caanan.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, by default, due to the appellant Mr. Lang failing to appear.

8) Case No. 12-418-R, Colleen M. Shuritz, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuen F. Bradford, Department of Emergency Services and Public Protection.

9) Case No. 12-396-R, Donald A. Piombo, involving the revocation of his pistol permit to carry pistols and revolvers. The appeallant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, at this time.

Secretary’s Report:

The January 10, 2013 minutes were tabled to the next meeting.

Old Business:

Mr. Fishbein mentioned a letter that was proposed by Chairman Corradino at the last meeting to address the proposed legislation to disclose the names of pistol permit holders. It was decided to table to the next hearing, Feb. 14, 2013.

Adjournment: Knapp made a motion to adjourn, Overturf seconded the motion, motion carried.
