BOARD OF FIREARMS PERMIT EXAMINERS

Thursday January 10, 12:00pm at the

Community Room, Wethersfield Police Department

Call to Order

Chairman Corradino called the meeting to order at 12:00pm.

Chairman Corradino read the Introductory Statement.

Chairman Corradino called the roll call 11 appellants were present and 1 appellant was absent.

The State Issuing Authority was present and 6 local Issuing Authorities were present.

Board Members Present: Attorney Joseph T. Corradino, Chairman, Atty. Craig Fishbein, Chief T. William Knapp, (Ret.), Atty. Jay Greer, Mr. M. Peter Kuck, Col. Kyle Overturf and Mr. Kenneth Tramadeo.

Chairman Corradino administered the oath to all witnesses.

Secretary Knapp made a motion to move case #10- to #1, #9 to #2, #1 to #3 and #6 to #4. No objections, motion carried.

Hearings:

1) Case No. 12-360-D, Timothy Gaughan, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Carl Rosensweig, Granby Police Department, represented the local Issuing Authority.

Motion: Corradino made a motion was made to continue the case until Feb. 14, 2013, no objections, motion carried.

2) Case No. 13-008-D, Daniel Tarasevich, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative for the local Issuing Authority, Chief Michael Crowley, failed to appear.

Decision: By a unanimous decision, the Board voted for Mr. Tarasevich to be issued a temporary pistol permit by default, due to the local Issuing Authority’s failure to appear.

3) Case No. 13-015-D, Cesar Arteaga, involving the denial of a pistol permit to carry pistols and revolvers. Attorney David E. Crow represented the appellant. Lt. Art Weisgerber represented the local Issuing Authority, Chief Harry Rilling, Norwalk Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of local Issuing Authority, Chief Harry Rilling, Norwalk Police Department.

4) Case No. 12-407-D, Ronald Vece, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. A representative of the local Issuing Authority, First Selectman Derrylyn Gorski, Town of Bethany, failed to appear.

Decision: By a unanimous decision, the Board voted to overturn the decision of local Issuing, First Selectman Derrylyn Gorski, Town of Bethany, by default for failure to appear.

5) Case No. 12-416-D, Charles Damato, Jr., involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Kim Nikola represented the local Issuing Authority, Chief Joseph Gaudett, Bridgeport Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of local Issuing Authority, Chief Joseph Gaudett, Bridgeport Police Department, by default due to the appellants Mr. Damato, failure to appear.

6) Case No. 12-4-14-D, Jason Campbell, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Carl Rosensweig, the local Issuing Authority for the Granby Police Department, appeared before the Board.

Decision: By a majority, the Board voted to overturn the decision of Chief Rosensweig, the local Issuing Authority, for the Granby Police Department. Greer voted for the local Issuing Authority. Corradino, Fishbein, Knapp, Kuck, Overturf and Tramadeo voted for the appellant, Mr. Campbell, to be issued a temporary pistol permit.

7) Case No. 12-356-D, David Godbout, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Attorney Mark S. Zamarka represented the local Issuing Authority First Selectman Paul M. Formica, Town of East Lyme with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of denial of the local Issuing Authority, First Selectman Paul M. Formica, Town of East Lyme. Mr. Kuck recused himself from the case.

8) Case No. 13-028-R, Kristopher Bottoni, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, by default due to the appellants, Mr. Bottoni, failure to appear.

9) Case No. 12-374-R, Earl Turner, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

10) Case No. 12-367-R, Barry Ritch, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

11) Case No. 12-373-R, Brien Toffey, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, at this time.

12) Case No.12-404-R, Casmore Jones, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Secretary’s Report:

1) Approval of the December 13, 2012 minutes. Tramadeo made a motion to accept the minutes as written, Kuck seconded the motion, motion carried.

New Business:

1) Executive Session: Motion: Chairman Corradino made a motion to “To go into Executive Session including staff.” Knapp seconded the motion, motion carried.

Motion: Knapp made a motion “To adjourn from Executive Session.” Corradino seconded, motion carried.

2) Legislative Issues:

Board members discussed sending a letter from the Board to the State Legislature about a proposed bill which would remove confidentiality of pistol permit owners. Kuck made a motion that the Board takes a position on the issue to maintain the confidentiality of those with pistol permits, motion was seconded by Fishbein. After discussion the Board Members voted on sending a letter with possible revisions. Corradino, Knapp, Greer, Kuck, Overturf and Tramadeo voted in favor of a letter with revisions, Fishbein voted against sending a letter with revisions. After further discussion, Corradino made a motion to table the issue until the next hearing on January 24, 2013, Fishbein seconded the motion, motion carried.
