Call to Order

Secretary T. William Knapp called the meeting to order at 12:00pm.

  

Secretary Knapp read the Introductory Statement

Chairman Corradino called the roll call, 7 appellants were present, 3 appellants failed to appear. The State Issuing Authority was present, 3 local Issuing Authorities were present, 2 local Issuing Authorities failed to appear.

Chairman Corradino read the Introductory Statement and administered the oath to all witnesses.

5 Board Members Present: Attorney Joseph T. Corradino, Chairman, Chief T. William Knapp, Board Secretary, Mr. M. Peter Kuck, Colonel Kyle E. Overturf and Kenneth Tramadeo.

2 Board Members Absent: Mr. Arthur Carr and Mr. Jay Greer. 

Cases scheduled for hearings:

1) Case No. 10-278-R, Thomas Kibbie vs. Board of Firearms Permit Examiners

Re: Memorandum of Decision on Appellants Request for New Hearing, dated March 8, 2012.

Chairman Corradino read the memorandum.*

Motion: Knapp made a motion to correct the date read by the Chairman to match the date written on page 5 as February 10, 2012. Tramadeo seconded the motion. Corradino, Knapp, Overturf and Tramadeo voted in favor of the correction. Kuck abstained.

Motion: Corradino made a motion to accept the memorandum as written as corrected. Knapp seconded the motion. Corradino, Knapp, Overturf and Tramadeo in favor of the motion. Kuck abstained. Motion carried.

2) Case No.12-128-R, Pasquale E. Natale, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, and voted for the reinstatement of Mr. Natale’s pistol permit.

3) Case No. 12-039-D, Benjamin Hodge, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Kim Nikola represented the local Issuing Authority, Chief Joseph Gaudett, Bridgeport Police Department.

Chairman Corradino made a phone call to the NY Prosecutors Training Institute. It was determined that the New York “relief of a disability” decision did not make Mr. Hodge eligible to obtain a Connecticut pistol permit to carry a pistol or revolver.

Motion: Corradino made a motion to uphold the decision to deny, by the local Issuing Authority, Chief Joseph Guadett, Bridgeport Police Department, due to Mr. Hodge being disqualified to carry a CT pistol permit.

4) Case No. 11-296-R, Alfred Davis involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear.

5) Case No. 11-272-R, Jonathan B. Wells, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Wells pistol permit at this time.

6) Case No. 11-260-R, Edward C. Lenox, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal due to his case pending in court and the Board voted for the State Issuing Authority, by default.

7) Case No. 12-050-D, Matthew L. O’Connor, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority, First Selectman Joyce Okonuk, Town of Lebanon, failed to appear.

Motion: Corradino made a motion for the appellant, by default, due to the local Issuing Authority, First Selectman Joyce Okonuk, Town of Lebanon, failure to appear. Knapp second the motion. Motion carried.

8) Case No. 11-262-R, Michael J. Dillman involving the revocation of his pistol permit to carry pistols and revolvers. Mr. Dillman failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Motion: Corradino made a motion for the State Issuing Authority, by default, due to the appellants, Mr. Dillman, failure to appear. Knapp seconded the motion. Motion carried.

9) Case No. 12-144-D, Patricia C. Hayn, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. The local Issuing Authority, First Selectman Gregg Schuster, Town of Colchester, failed to appear.

Motion: Corradino made a motion for the appellant, by default, due to the local Issuing Authority, First Selectman Gregg Schuster, Town of Colchester, failure to appear. Knapp  second the motion. Motion carried.

10) Case No. 11-247-D, Jason D. Riddle, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. The local Issuing Authority, Chief Joe Hurliman, Shelton Police Department, was represented at the Board.

Motion: Corradino made a motion for the local Issuing Authority Chief Joe Hurliman, Shelton Police Department, by default, due to the appellants, Mr. Riddle, failure to appear. Knapp seconded the motion. Motion carried.

11) Case No. 12-001-D, Kyshant T. Moore, Sr., involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Elizabeth Mazza represented the local Issuing Authority, Chief Dean Esserman, New Haven Police Department.  

Motion: Knapp made a motion for the appellant, Mr. Moore, by default, due to the local Issuing Authority, New Haven Police Department, failing to provide the written statement as to why the appellant was denied, 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). Kuck seconded the motion, motion carried.

Secretary’s Report:

1) Approval of the February 10, 2012 Minutes. Knapp made a motion to accept the minutes as written, Overturf seconded the motion, motion carried. Tramadeo abstained.

2) 18 cases were resolved prior to the hearing.
