Call to Order

Secretary T. William Knapp called the meeting to order at 12:00pm.

  

Secretary Knapp read the Introductory Statement

Secretary Knapp called the roll call, 20 appellants were present, 2 appellants failed to appear. 19 local Issuing Authorities were present, 3 local Issuing Authorities failed to appear.

5 Board Members Present: Attorney Joseph T. Corradino, Chairman, Chief T. William Knapp, Board Secretary, Mr. M. Peter Kuck, Colonel Kyle E. Overturf* and Kenneth Tramadeo. *Overturf left the meeting at 4pm.

1 Board Member Absent: Mr. Jay Greer. 

Chairman Joseph T. Corradino read a Memoriam regarding the loss of Arthur C. Carr, Board member for 37 years. (see attached)

Chairman Joseph T. Corradino administered the oath to all witnesses.

1) Case No. 12-120-D, Angelo Corsi, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative appeared from the local Issuing Authority Chief Patrick Ridenhour, Stratford Police Department.

Withdrawl: The appellant withdrew his appeal and will reapply for a pistol permit with the correct information.

2) Case No. 12-017-D, Amy Colon, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. A representative appeared from the local Issuing Authority Chief Patrick Ridenhour, Stratford Police Department.

Withdrawal: The appellant withdrew her appeal and will reapply for a pistol permit with the correct information.

3) Case No. 11-232-D, Alexander Barletta involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lewis Palshaw, Records Supervisor appeared for the local Issuing Authority, Chief James Kenney, Vernon Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority Chief James Kenney, Vernon Police Department, at this time.

4) Case No. 12-145-D, Reed Boccuzzi involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Captain Tom Wendell appeared for the local Issuing Authority, Chief Alan Baker, Danbury Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority Chief Alan Baker, Danbury Police Department, at this time. Col. Overturf recused himself.

5) Case No. 12-160-D, Christian Ackermann, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Donald Bisi appeared for the local Issuing Authority Chief David Caron, Glastonbury Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority Chief David Caron, Glastonbury Police Department and for Mr. Ackermann to be issued a temporary pistol permit.

6) Case No. 12-078-D, Jordan Valenti, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Thomas P. Mullaney, III represented the appellant. Lt. Donald Bisi appeared for the local Issuing Authority Chief David Caron, Glastonbury Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority Chief David Caron, Glastonbury Police Department and for Mr. Valenti to be issued a temporary pistol permit.

7) Case No. 12-171-D, Nicholas Bousquet involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Mark Mikulski appeared for the local Issuing Authority, Chief Douglas Dortenzio Wallingford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority Chief Douglas Dortenzio Wallingford Police Department, at this time.

8) Case No. 12-048-D, Brittany Caras, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative from the local Issuing Authority appeared for Chief Bruno Giulini City of Groton Police Department.

Motion: Corradino made a motion for the local Issuing Authority, by default, due to the appellants’ failure to appear. Knapp  second the motion. Motion carried.

9) Case No. 12-067-D, Steven Browne involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Leonard Scinto appeared for the local Issuing Authority Chief Thomas Kiely, Trumbull Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority Chief Thomas Kiely, Trumbull Police Department and for Mr. Browne to be issued a temporary pistol permit.

*Colonel Overturf left the meeting at 4pm. A quorum of 4 members remained.

10) Case No. 12-057-D, Jeffrey Myshka involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Leonard Bunnell appeared for the local Issuing Authority Mayor Ronald McDaniel, Town of Montville.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority Mayor Ronald McDaniel, Town of Montville and for Mr. Myshka to be issued a temporary pistol permit.

11) Case No. 12-126-D, James Moreau involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Captain Golden appeared for the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority Chief Carl Sferrazza, Enfield Police Department and for Mr. Moreau to be issued a temporary pistol permit.

12) Case No. 12-082-D, Joseph Sousa, Jr. involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Trooper Smith appeared for the local Issuing Authority, Town Manager Steven Werbner, Town of Tolland.

Withdrawal: The appellant withdrew his appeal and will reapply for a pistol permit with the correct information.

13) Case No. 12-117-D, Andrew Gay, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer DeStefano appeared for the local Issuing Authority, Chief Keith Mello, Milford Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority Chief Keith Mello, Milford Police Department and for Mr. Gay to be issued a temporary pistol permit.

14) Case No. 12-101-D, Erik Schmaling, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Captain Tom Wendell appeared for the local Issuing Authority, Chief Keith Mello, Milford Police Department.

Withdrawal: The appellant withdrew his appeal.

15) Case No. 12-130-D, Ronald Jacquemin involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Plasczynski appeared for the local Issuing Authority, Chief Eric Osanitsch, Bristol Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority Chief Eric Osanitsch, Bristol Police Department and for Mr. Jacquemin to be issued a temporary pistol permit.

16) Case No. 11-207-D, Eddy Ramirez, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Officer Elizabeth Mazza appeared for the local Issuing Authority Chief Dean Esserman, New Haven Police Department.

Motion: Corradino made a motion for the local Issuing Authority, by default, due to the appellants’ failure to appear. Knapp second the motion. Motion carried.

17) Case No. 12-045-D, Jesse Hovanesian, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Plasczynski appeared for the local Issuing Authority Chief Eric Ostanitsch, Bristol Police Department.

Motion: Knapp made a motion for the appellant, Mr. Hovanesian, by default, due to the local Issuing Authority, Bristol Police Department, failing to provide the written statement as to why the appellant was denied, 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). Tramadeo seconded the motion, motion carried.

18) Case No. 12-165-D, Vincent Schoepfer involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority was represented by First Selectman John Hodge, Town of New Fairfield.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority First Selectman John Hodge, Town of New Fairfield, at this time.

19) Case No. 12-141-D, Alan Simons involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Brian Mullins appeared for the local Issuing Authority, Chief Matthew Catania, Plainville Police Department.

Withdrawal: The appellant withdrew his appeal.

20) Case No. 11-284-D, Miroslaw Puchalski involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Pesce appeared for the local Issuing Authority Chief Brian Heavren, Hartford Police Department.

Motion: Knapp made a motion for the appellant, Mr. Puchalski, by default, due to the local Issuing Authority, Hartford Police Department, failing to provide the written statement as to why the appellant was denied, 10 days prior to the hearing in accordance with C.G.S. 29-32b(c). Tramadeo seconded the motion, motion carried.

21) Case No. 12-067-D, Robert Stephens involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority Town Manager Matthew Hart, Town of Mansfield, failed to appear.

Motion: Corradino made a motion for the appellant Mr. Stephens, by default, local Issuing Authority, Town Manager Matthew Hart, Town of Mansfield, failing to appear. Knapp seconded the motion, motion carried.

22) Case No. 12-140-D, Joshua Braccidiferro, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative from the local Issuing Authority Chief William McKenna, Middletown Police Department failed to appear.

Motion: Due to both the appellant and local issuing authority failing to appear, Corradino made a motion to dismiss due to lack of due process. Knapp seconded the motion, motion carried.

Secretary’s Report:

1) Approval of the March 8, 2012 Minutes. Knapp made a motion to accept the minutes as written, Tramadeo seconded the motion, motion carried.

2) 7 cases were resolved prior to the hearing.

3) Secretary Knapp acknowledged that Mr. Carr was instrumental in writing the Declaratory Ruling and he had stated that was one of his greatest contributions to the Board.
