Call to Order

Board Secretary T. William Knapp called the meeting to order.

  

Secretary Knapp read the Introductory Statement.

Secretary Knapp called the roll call 13 appellants were present, the State Issuing Authority was present and 5 local Issuing Authorities were present.

6 Board Members Present: Attorney Joseph T. Corradino, Chairman, Chief T. William Knapp, (Ret.), Board Secretary, Mr. M. Peter Kuck, Colonel Kyle E. Overturf and Mr. Kenneth Tramadeo

1 Board Member Absent: Mr. Jay Greer

Board Chairman, Corradino administered the oath to all witnesses.

1) Case No. 12-055-D, Matthew Marino involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. St. John Desmaris and Officer Edward Demers represented the local Issuing Authority, Chief Richard Guisti, Middlebury Police Department.

Motion: Chairman Corradino made a motion to continue the case to July 27, 2012. Knapp seconded the motion, motion carried. (The case has now be rescheduled for Sept. 13, 2012)

2) Case No. 12-090-D, Jeffrey Boice involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Capt. Dennis Lesser represented the local Issuing Authority Chief David Caron, Glastonbury Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority Chief David Caron, Glastonbury Police Department, to deny Mr. Boice a pistol permit, at this time. 

3) Case No. 11-238-R, Darrion A. Williams, Jr. involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paulo D’Allessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of Mr. Williams pistol permit due to a pending protective order.

4) Case No. 11-310-R, James W. Shelmerdine, Jr. involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Rachel M. Baird, represented the appellant. Sgt. Paulo D’Allesandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, with two witnesses.

Decision: By a unanimous decision, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection and voted for Mr. Shelmerdine to be reinstated his pistol permit.

5) Case No. 12-092-R, Ricardo Chardon involving the revocation of his pistol permit to carry pistols and revolvers. Sgt. Paulo D’Allessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: Sgt. D’Allessandro informed the Board that Mr. Chardon was reissued his pistol permit just prior to the hearing. Mr. Chardon withdrew his appeal

6) Case No. 12-075-R, Frank Chandler involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paulo D’Allesandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Withdrawal: The appellant withdrew his appeal.

7) Case No. 12-051-R, Abraham Nieves, Jr. involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paulo D’Allesandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of Mr. Nieves pistol permit due to a pending protective order. 

8) Case No. 12-064-R, Thomas Fedock, involving the revocation of his pistol permit to carry pistols and revolvers. Sgt. Paulo D’Allesandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant, Mr. Fedock notified the Board’s office prior to the hearing that he was reissued his pistol permit prior to the hearing and therefore withdrew his appeal.

9) Case No. 12-105-R, Diana R. Roy involving the revocation of her pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Paulo D’Allesandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Ms. Roy’s pistol permit at this time.

10) Case No. 11-283-R, Christopher C. Falquero, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Paulo D’Allesandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection by default due to the appellant’s failure to appear.

11) Case No. 12-081-D, Josh Warner, involving the denial of a pistol permit to carry pistols and revolvers. Mr. Warner was represented by Attorney Brian A. Desautels. The local Issuing Authority, Chief Robert j. Gagne, Orange Police Department.

Withdrawal: The appellant, represented by his attorney, withdrew his appeal prior to the hearing. By default the decision is in favor of the local Issuing Authority.

12) Case No. 12-115-D, Andrew Parsons, involving the denial of a pistol permit to carry pistols and revolvers. Mr. Parson appeared on his own behalf. Sgt. John Zemaitis represented the local Issuing Authority, Chief Richard Mulhall, Newington Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority Chief Richard Mulhall, Newington Police Department, and voted for Mr. Parsons to be issued his temporary pistol permit.

13) Case No. 12-106-D, Joel A. Goldberg, involving the denial of a pistol permit to carry pistols and revolvers. Mr. Parson appeared on his own behalf. Lt. Edward Remington represented the local Issuing Authority, Chief Thomas McLaughlin, North Haven Police Department with one witness.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority Chief Thomas McLaughlin, North Haven Police Department, and voted for Mr. Goldberg to be issued his temporary pistol permit.

Secretary’s Report:

1) Approval of the May 10, 2012 Minutes. Knapp made a motion to accept the minutes as written, Overturf seconded the motion, motion carried.
