Call to Order

Chairman Joseph T. Corradino called the meeting to order.

  

Corradino read the Introductory Statement.

Corradino called the roll call 13 appellants were present, 2 appellants absent, the State Issuing Authority was present and 2 local Issuing Authorities were present, 1 local Issuing Authority was absent.

Board Members Present: Attorney Joseph T. Corradino, Chairman, Chief T. William Knapp, (Ret.), Board Secretary, Mr. Jay Greer, Mr. M. Peter Kuck, Colonel Kyle E. Overturf and Mr. Kenneth Tramadeo

Board Chairman, Corradino administered the oath to all witnesses.

1) Case No. 12-081B-R, Richard S. Grzesiak, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal due to an active protective order.

2) Case No. 12-091-R, Orville Lindton involving the revocation of his pistol permit to carry pistols and revolvers. The appellant notified the Board prior to hearing he would not be attending. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal prior to the hearing with no reason given.

3) Case No. 12-143-R, Francesco Sorrentino involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection

Withdrawal: The appellant withdrew his appeal due to an active protective order.

4) Case No. 12-156-R, John Marus involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal due to an active protective order.

5) Case No. 12-155-R, Walber Lopez involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, by default, for the appellant’s failure to appear.

6) Case No. 12-134-R, Brant Cadovius, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney John R. Downey represented the appellant. Sgt. Paolo D’Alesandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to uphold the decision of the State Issuing Authority, the revocation of Mr. Cadovius’s pistol permit. Kuck voted for the appellant. Corradino, Greer, Knapp, Tramadeo and Overturf voted for the State Issuing Authority.

7) Case No. 12-099-D, Edwin Stevens, Sr. involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Robert Sampson represented the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department.

Withdrawal: The appellant will withdraw his appeal and will reapply with correct information.

8) Case No. 11-207-D, Eddy Ramirez, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Matthew Popilowski represented the appellant. Officer Elizabeth Mazza represented the local Issuing Authority, Chief Dean Esserman, New Haven Police Department.

Decision: By a majority, the Board voted to uphold the decision of the State Issuing Authority, the revocation of Mr. Ramirez’s pistol permit. Corradino and Kuck voted for the appellant. Greer, Knapp, Tramadeo and Overturf voted for the State Issuing Authority.

9) Case No. 12-098-R, Renee Stefanko involving the revocation of her pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Ms. Stefanko’s pistol permit, at this time.

10) Case No. 12-063-R, Anthony Ortiz, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Frank T. Canace represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Ortiz’s pistol permit, at this time.

11) Case No. 12-121-R, Rafal Maslowski involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Frank T. Canace represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Maslowski’s pistol permit, at this time.

12) Case No. 12-108-R, Scott N. Damato Marus, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear.

13) Case No. 12-071-R, Matthew M. Altieri, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear.

14) Case No. 12-112-R, Douglas Church, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to overturn the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, and voted for Mr. Church’s pistol permit to be reinstated.

15) Case No. 12-169-D, Edward Sanchez, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority, Chief Joel W. Hurliman, Shelton Police Department called the office just prior to the hearing to withdraw the denial of Mr. Sanchez’s pistol permit.

Motion: Mr. Tramadeo made a motion in favor of the appellant, Col. Overturf seconded the motion, motion carried.

16) Case No. 12-085-D, Brian P. McArdle, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. A representative of the local Issuing Authority, Chief Gary MacNamara, Fairfield Police Department, failed to appear. 

Decision: By a unanimous decision, the Board voted to overturn the local Issuing Authority, Chief Gary MacNamara, Fairfield Police Department, by default, and voted for the appellant, McArdle, to be issued a temporary pistol permit, due to Fairfield Police Department representative’s failure to appear.

Secretary’s Report:

1) Approval of the June 14, 2012 Minutes. Tramadeo made a motion to accept the minutes as written, Kuck seconded the motion, motion carried.
