Call to Order

Chairman Joseph T. Corradino, Esq. called the meeting to order at 12:00pm.

  

Chairman Corradino called the roll call, 13 appellants were present. The State Issuing Authority and 4 local Issuing Authorities were present.

Chairman Corradino read the Introductory Statement and administered the oath to all witnesses.

6 Board Members Present: Chairman Joseph T. Corradino, Esq., Secretary T. William Knapp, Mr. Jay Greer, Mr. Arthur Carr, Mr. Peter Kuck, and Colonel Kyle E. Overturf.

1 Board Member Absent: Mr. Kenneth V. Tramadeo. 

Cases scheduled for hearings:

1) Thomas Kibbie vs. Board of Firearms Permit Examiners Motion to Reconsider

Case No. 10-278-R, Thomas Kibbie vs. Commissioner Reuben Bradford, Dept. of Emergency Services and Public Protection.

Chairman Corradino has requested that the appellant, Mr. Kibbie to file a pleading setting forth the reasons why a new hearing should be held limited to the defects in the process that would have deprived him of due process, and any evidence on the substantive issue of suitability that he was unable to present due to the defects he claims and a legal analysis based on the affect of the defects and a harmless analysis as well, within 10 days or February 20, 2012. The Commissioner of DESPP will file a response to the pleading by March 2, 2012. The Board will hear the motion for reconsideration.

Mr. Knapp made a motion to endorse the Chairman Corradino’s actions. Seeing no objection, the Board voted unanimously to endorse the Chairman.

2) Case No. 1211-256-R, Trevon Dowdell, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Lawrence Terra represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant, Mr. Dowdell, withdrew his appeal.

3) Case No. 11-315-R, Raymond Weston, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Lawrence Terra represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a unanimous decision, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, and voted for the reinstatement of Mr. Weston’s pistol permit.

4) Case No. 11-235-R, Frank Martone, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Lawrence Terra represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: Det. Imbimbo, on behalf of Commissioner Bradford, informed the Board members that Mr. Martone would be reissued his pistol permit on Tuesday, February 15, 2012. The appellant, Mr. Martone, agreed to withdraw his appeal.

5) Case No. 11-223-R, Scott Courtemanche, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Lawrence Terra represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawl: The appellant, Mr. Courtemanche, withdrew his appeal.

6) Case No. 11-270-R, 11-270-R, James Ranelli involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Lawrence Terra represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: Det. Imbimbo, on behalf of Commissioner Bradford, informed the Board members that Mr. Ranelli would be reissued his pistol permit. The appellant, Mr. Ranelli, agreed to withdraw his appeal.

7) Case No. 11-240-R Cliff Onofrio, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Lawrence Terra represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with 2 witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, at this time.

8) Case No. 11-268-R, Anthony Tomasiello, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Lawrence Terra represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

9) Case No. 11-289-R, Eric Williams, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Lawrence Terra represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection and for Mr. Williams to be reinstated his pistol permit.

10) Case No. 12-040-D, Kenneth Page, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Elizabeth Mazza represented the local Issuing Authority, Chief Dean Esserman, New Haven Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Dean Esserman, New Haven Police Department, and for Mr. Page to be issued a temporary pistol permit.

11) Case No. 12-042-D, Jason Lopardo, involving the denial of a pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Sgt. John Recchini represented the local Issuing Authority, Chief Michael Maniago, Torrington Police Department.  

Decision: The Board vote was tied resulting in a decision in favor of the appellant. Greer, Knapp and Overturf voted in favor of the local Issuing Authority, Chief Michael Maniago, Torrington Police Department. Carr, Corradino and Kuck voted for the appellant. A tie vote results are in favor of the appellant, Mr. Lopardo, being issued a temporary pistol permit.

12) Case No. 11-319-D, Elbert Grey, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Spragg represented the local Issuing Authority, Chief Mark Sirois, East Hartford Police Department.  

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Mark Sirois, East Hartford Police Department, and for Mr. Grey to be issued a temporary pistol permit.

13) Case No. 11-321-D, Barry Young, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative from the local Issuing Authority, Waterbury Police Department, failed to appear.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Michael Gugliotti, Waterbury Police Department, by default due to the local Issuing Authority failure to appear. As a result, it is ordered by the Board that Mr. Young is to be issued a temporary pistol permit.

14) Case No. 11-275-R, Kayla Cohen, involving the revocation of her pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf with one witness. Lt. Lawrence Terra represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of her pistol permit.

Secretary’s Report:

1) Approval of the January 27, 2012 Minutes. Overturf made a motion to accept the minutes as written, Knapp seconded the motion, motion carried.
