Call to Order

Secretary T. William Knapp called the meeting to order at 12:00pm.

  

Secretary Knapp read the Introductory Statement.

Secretary Knapp called the roll call 9 appellants were present, 3 appellants absent, the State Issuing Authority was present and 2 local Issuing Authorities were present.

Board Members Present: Attorney Joseph T. Corradino, Chairman, Chief T. William Knapp, (Ret.), Board Secretary, Mr. Jay Greer, Mr. M. Peter Kuck, Col. Kyle Overturf and Mr. Kenneth Tramadeo

Board Chairman, Corradino administered the oath to all witnesses.

Hearings

1) Case No. 10-278-R, Thomas Kibbie, remanded from Superior Court, involving the revocation of his pistol permit to carry pistols and revolvers. Sgt. Paolo D’Alessandro was present for the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the revocation of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

2) Case No. 12-146-R, Michael D. Tutoli, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection. 

Withdrawal: The appellant withdrew his appeal due to an active protective order.

3) Case No. 12-255-R, David R. Esposito, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection. 

Withdrawal: The appellant withdrew his appeal due to an active protective order.

4) Case No. 12-170-R, Adam A. McClintick involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal due to an active protective order.

5) Case No. 12-201-R, Christopher Brissett, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection. 

Decision: By a unanimous decision, the Board voted to uphold the revocation of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, by default, due to the appellants failure to appear.

6) Case No. 12-142-R, Christen Collington, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to overturn the revocation of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection and voted to reinstate Mr. Collington’s pistol permit. Corradino voted for the Issuing Authority. Greer, Knapp, Kuck, Overturf and Tramadeo voted for the appellant.

7) Case No. 12-215-R, Ronald Catuccio, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Clifford Comford represented the appellant with three witnesses. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a majority, the Board voted to uphold the revocation of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection. Kuck voted for the appellant. Corradino, Greer, Knapp, Overturf and Tramadeo voted for the State Issuing Authority.

8) Case No. 12-331-D, Corey A. Feron, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Carl Rosensweig, Granby Police Department represented the local Issuing Authority.

Decision: By a unanimous decision, the Board voted to overturn the denial of the local Issuing Authority, Chief Carl Rosensweig, Granby Police Department, and voted for Mr. Feron to be issued a temporary pistol permit. Greer voted for the local Issuing Authority. Corradino, Knapp, Kuck, Overturf and Tramadeo voted for the appellant.

9) Case No. 12-303-D, Eric E. Sokoloski, involving the denial pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Alfred Mayo represented the local Issuing Authority, Chief Brent Larabee, East Haven Police Department.

Decision: By a unanimous decision, the Board voted to uphold the denial of the local Issuing Authority, Chief Brent Larabee, East Haven Police Department, at this time.

10) Case No. 12-282-R, Joseph E. Salvati, Jr., involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with two witnesses. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the revocation of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, at this time.

11) Case No. 12-278-R, Arnulfo Aguilar, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Guy P. Soares represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.

Decision: By a tie vote, the Board voted to overturn the revocation decision of the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection and with a tie vote in favor of the appellant, the Board voted for the appellant to be reinstated his pistol permit. Corradino, Greer and Overturf voted for the State Issuing Authority. Knapp, Kick and Tramadeo voted for the appellant.

12) Case No. 12-124-R, Edmund Sterniak, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant, represented by Attorney Ralph D. Sherman, withdrew his appeal. The State Issuing Authority informed the Board that the appellant was reissued his pistol permit prior to the hearing.

Secretary’s Report:

1) Approval of the July 26, 2012 Minutes. Knapp made a motion to accept the minutes as written, Tramadeo seconded the motion, motion carried. Overturf abstained.

2) Approval of the July 27, 2012 Minutes. Knapp made a motion to accept the minutes as written, Tramadeo seconded the motion, motion carried. Overturf abstained.

Adjournment: Tramadeo made a motion to adjourn, Kuck seconded the motion, motion carried at 9:50pm.
