BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Attorney Craig Fishbein, Acting Chairman, called the meeting to order at 10:00am.

Acting Chairman Fishbein read the Introductory Statement and called the roll call. 7 appellants were present and 7 local Issuing Authorities were present.

Acting Chairman Fishbein administered the oath to all witnesses.

Board Members Present: Chairman Frank P. Blando*, Esq., Secretary Craig C. Fishbein, Esq., James A. Greer, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck**, Col. Kyle Overturf and Chief Carl Rosensweig.

Hearings:

1) Case No. 14-094-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. James Smith, Montville Police Department represented the local Issuing Authority, Mayor Ronald McDaniel, with one witness. 

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Sgt. James Smith, Montville Police Department on behalf of Mayor McDaniel, the denial of a temporary pistol permit, at this time.

2) Case No. 14-292-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Officer Suchecki represented the local Issuing Authority, First Selectman, Stanley F. Soby, Town of Colchester, with one witness. 

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, First Selectman Stanley F. Soby, the denial of a temporary pistol permit, at this time.

3) Case No. 14-213-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf with one witness. Lt. Stacy Sacharko represented the local Issuing Authority, Chief Douglas L. Dortenzio, Wallingford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Douglas L. Dortenzio, Wallingford Police Department, the denial of a temporary pistol permit.

4) Case No. 14-298-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Heather Desmond represented the local Issuing Authority, Chief William McKenna, Middletown Police Department. 

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief William McKenna, Middletown Police Department, the denial of a temporary pistol permit, at this time.

5) Case No. 15-137-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant with one witness. Lt. Heather Desmond represented the local Issuing Authority, Chief William McKenna, Middletown Police Department. 

Decision: By a majority, the Board voted to overturn the decision of the local Issuing Authority, Chief William McKenna, Middletown Police Department, and ordered a temporary pistol permit to be issued.  Board Members Johnson and Rosensweig voted for the Issuing Authority. Board Members Blando, Fishbein, Greer and Kuck voted for the appellant.

6) Case No. 14-304-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Officer Gannon represented the local Issuing Authority, Chief Mark Rinaldo, Avon Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Mark Rinaldo, Avon Police Department, and ordered a temporary pistol permit to be issued. 

7) Case No. 15-007-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Andrew Dzierzgowski represented the local Issuing Authority, Chief Eric Osanitsch, Windsor Locks Police Department with one witness. 

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Eric Osanitsch, Windsor Police Department, the denial of a temporary pistol permit.

Secretary’s Report:

Fishbein called for a motion to accept the January 8, 2015 minutes as written, Greer made the motion, Johnson seconded the motion, motion carried.
