BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:00am.

Chairman Frank P. Blando, read the Introductory Statement and called the roll call. Seven appellants were present and one failed to appear. The State Issuing Authority was present, three local Issuing Authorities were present and one failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Dr. S. David Bernstein, James A. Greer, Esq., Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Ms. Gudrun Johnson and Mr. M. Peter Kuck.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings:

1) Case No. 14-095-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Michael Kehoe, Newtown Police Department appeared as the representative for the local Issuing Authority.

Motion: Fishbein made a motion to accept the agreement between the appellant and the local Issuing Authority, Chief Michael Kehoe, Newtown Police Department; the appellant would withdraw his appeal and Chief Kehoe would issue the permit that same day, July 10, 2014. Rosensweig seconded the motion, motion carried unanimously.

2) Case No. 14-020-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Kim Nikola appeared on behalf of the local Issuing Authority, Chief Joseph L. Gaudett, Bridgeport Police Department.

Motion: Fishbein made a motion in favor of the local Issuing Authority, Chief Joseph L. Gaudett, Bridgeport Police Department, by default, due to the appellant’s failure to appear. Overturf seconded the motion, motion carried unanimously.

3) Case No. 14-032-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Kim Nikola appeared on behalf of the local Issuing Authority, Chief Joseph L. Gaudett, Bridgeport Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of local Issuing Authority, Chief Joseph L. Gaudett, Bridgeport Police Department the denial of a pistol permit.

4) Case No. 14-163-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority, Town Manager Andrew Tierney, Town of Hebron, failed to appear.

Decision: By a unanimous decision, the Board voted to overturn the decision of local Issuing Authority, Town Manager Andrew Tierney, Town of Hebron, by default, due to the local Issuing Authority’s failure to appear and the Board ordered the temporary pistol permit to be issued.

5) Case No. 14-010-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney John T. Walkley represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit. Blando voted for the appellant. Bernstein, Fishbein, Greer, Overturf and Rosensweig voted for the State Issuing Authority.

6) Case No. 14-016-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the State pistol permit.

7) Case No. 14-043-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Richard S. Cramer represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the State pistol permit.

8) Case No. 14-079-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the State pistol permit.

Secretary’s Report:

1)Fishbein made the motion to accept the June 12, 2014 minutes as written, Rosensweig seconded the motion,  motion carried unanimously.

2) Fishbein made a motion to add an additional meeting to be held on September 25, 2014 in an effort to reduce the wait time for a hearing. Overturf seconded the motion, motion carried unanimously.

Adjournment: Chairman Blando made a motion to adjourn, Overturf seconded the motion, motion carried. Meeting adjourned at 5:15pm.
