BOARD OF FIREARMS PERMIT EXAMINERS

Wethersfield Police Dept., Wethersfield, CT 06109

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:00am.

Chairman Blando, read the Introductory Statement and called the roll call. Seven appellants were present and two appellants failed to appear and one appellant left before the case was heard. The State Issuing Authority was present. Six local Issuing Authorities were present and one local Issuing Authority failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq.*. Dr. Charles Dike, Ms. Gudrun Johnson, Mr. M. Peter Kuck, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: James A. Greer, Esq.,

Chairman Blando administered the oath to all witnesses.

Hearings: 10 cases were heard in the following order:

1) Case No. 14-505-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. First Selectman Richard Matters represented the local Issuing Authority, the Town of Franklin.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, First Selectman Richard Matters, the denial of a temporary pistol permit, at this time.

2) Case No. 14-423-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. First Selectman Richard Matters represented the local Issuing Authority, the Town of Franklin. 

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, First Selectman Richard Matters, and ordered a temporary pistol permit to be issued.

3) Case No. 14-352-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Vincent Imbimbo represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Rosensweig made a motion in favor of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear. Board Member Kuck seconded the motion, motion carried unanimously.

4) Case No. 14-489-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Deputy Chief Baraja appeared for the local Issuing Authority, Chief Joseph L. Gaudett, Bridgeport Police Department, with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Joseph L. Gaudett, Bridgeport Police Department, the denial of a temporary pistol permit. 

5) Case No. 14-373-D, , involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative for the local Issuing Authority, Chief Robert M. Scannell, Winchester Police Department, failed to appear.

Motion: Board Member Fishbein made a motion in favor of the appellant, by default, due to a representative from the local Issuing Authority, Chief Robert M. Scannell, Winchester Police Department, failure to appear. Board Member Kuck seconded the motion, motion carried unanimously. The Board ordered a temporary pistol permit to be issued.

6) Case No. 14-456-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Vincent Imbimbo represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Kuck made a motion in favor of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear. Board Member Johnson seconded the motion, motion carried unanimously.

7) Case No. 14-411-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Art Weisgerber appeared for the local Issuing Authority, Chief Thomas Kulhawik, Norwalk Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Thomas Kulhawik, Norwalk Police Department, the denial of a temporary pistol permit, at this time.

8) Case No. 14-509-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant arrived and left the meeting 2.5 hours before her case was heard.  A representative for the local Issuing Authority, First Selectman Mark Walter, Town of East Haddam, was present for the hearing.

Motion: Board Member Fishbein made a motion to find for the local Issuing Authority, First Selectman Mark Walter, Town of East Haddam, due to the appellant’s failure to appear. Board Member Kuck made a friendly motion to note that the appellant was present at the beginning of the meeting and then left before her case was heard. Board Member Kuck seconded the motion with the friendly amendment, motion carried unanimously.

9) Case No. 14-464-SD, involving the revocation of her pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Det. Vincent Imbimbo represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Agreement: The appellant agreed to withdraw her appeal and Det. Imbimbo representing the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, agreed to issue the permit when the protective order expires on November 12, 2015.

10) Case No. 14-413-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Deputy Chief Robert Desena appeared for the local Issuing Authority, Chief John C. Gavallas, Watertown Police Department, with one witness.

Motion: Board Member Fishbein made a motion in favor of the appellant, Board Member Rosensweig seconded the motion, motion carried unanimously. The Board ordered a temporary pistol permit to be issued.

Secretary’s Report:

Board Secretary Fishbein made a motion to accept the August 13, 2015 minutes as written, Board Member Johnson seconded the motion, motion carried. Board Member Dike abstained.

Adjournment: Board Member Kuck made a motion to adjourn, Board Member Fishbein seconded the motion, motion carried unanimously. Meeting adjourned at 1pm.
