Allegation(s)
Issue 1: The Parent alleged that the District failed to provide her with prior written notice (PWN) after the Parent requested comprehensive educational and neuropsychological evaluations which were refused by the District at the Student’s June 2, 2026, PPT meeting. (34 CFR § 300.503, RCSA § 10-76d-8)
Issue 2: The Parent alleged that the District failed to provide her with a copy of the Student’s June 2, 2026, IEP within the required 5 school day time line.( RCSA § 10‑76d‑13(a)(6))
Issue 3: The Parent alleged that, despite it being stated at the Student’s June 2, 2026, PPT meeting that it was suspected that the Student may have dyslexia, the District refused to conduct parent-requested literacy and neuropsychological testing to identify the specific nature of the Student’s reading deficit. (34 CFR § 300.304(c)(6))
Conclusion(s)
Issue 1: On June 17, 2026, the District provided a PWN to the Parent via the CT-SEDS Parent Portal for the refusal to conduct the parent-requested evaluations which occurred at the Student’s June 2, 2026, PPT meeting. Such provision of the PWN meets the requirements of 34 CFR § 300.503. Since the provision of such PWN was to be effective September 11, 2026, the requirements of RCSA § 10-76d-8 were also met, in that the Parent was provided with the notice not later than ten [school] days before the PPT proposed that the action take effect.
It was concluded that the District was in compliance with 34 CFR § 300.503 and RCSA § 10-76d-8. No corrective actions were issued.
Issue 2: On June 10, 2026, the District provided a copy of the Student’s June 2, 2026, IEP to the Parent via the CT-SEDS Parent Portal, one day beyond the 5-school day requirement for such provision. It was concluded that the District was not in compliance with RCSA § 10‑76d‑13(a)(6). Corrective actions were issued.
Issue 3: Dyslexia assessments typically involve a comprehensive psychoeducational evaluation that measures reading, language, cognitive, and academic skills to identify strengths, weaknesses, and learning needs. The Student has been extensively evaluated to determine learning needs in order to develop an appropriate program. Of the Student’s 23 assessment results to which the District has access, 11 are noted to have relevance when considered toward diagnosing and programming for dyslexia and an additional 3 assessments are specific to diagnosing and programming for dyslexia. Though the Parent has requested additional literacy and neuropsychological testing, the Student’s available assessment information is adequate to identify the Student’s learning needs and develop an appropriate program to address those needs. It was concluded that the District was in compliance with 34 CFR § 300.304(c)(6). No corrective actions were issued.
Corrective Action(s)
- On or before October 30, 2026, the District shall provide training to appropriate staff related to the provision of IEPs to parents within the required 5 school day timeline.
- The District shall determine which staff are appropriate to participate in the training
- The District shall determine the manner in which the training is conducted, (e.g., memorandum to staff, in-person training, virtual training).
