Allegation(s)

The Parents allege that the District failed to provide language/communication services for 20 minutes, two times per week, as required in the Student’s Individualized Education Program (IEP) since the start of the 2026-2027 school year on August 27, 2026. (34 CFR §§ 300.323(c)(2), 300.17, and RCSA § 10-76d-1(a)(1)).

Conclusion(s)

The District has provided evidence of their prompt response to the SLP vacancy by promptly posting for the position, communicating with the families impacted by the vacancy, utilizing current SLP staff to the extent possible, contracting with outside agencies, maintaining a log of missed sessions, and providing ongoing communication to families regarding the staffing issue. However, the District is still obligated to provide the Student with all special education and related services listed in the IEP. As they failed to provide all language/communication services as required in the Student’s IEP, they are in violation of 34 CFR §§ 300.323(c)(2) and 300.17, and RCSA § 10-76d-1(a)(1). Given the documentation of efforts thus far, limited corrective action will follow.

Corrective Action(s)

  • Until the official starting date of the full-time contracted SLP, the District must track all language/communication services for the Student. The service log must include the date, and whether or not the Student was provided with the service. If the Student was not provided with the service, the service log must note the reason the service was not provided. On or before November 1, 2026, the District must submit a copy of the service log to the CSDE as evidence that the Student was provided with the service.
  • The District must provide the Student with 40 minutes of compensatory education to make up for the missed language/communication services as of September 15, 2026. Any additional missed service time as identified through corrective action #1 must also be provided. This provision aims to ensure that the Student receives the necessary support to address any gaps in his education and to facilitate his continued progress and development. If the District and the Parents encounter a disagreement about the scheduling of services, the District shall contact this office and the investigator will decide. The Parents are free to decline the offer of compensatory education in whole or in part. The District shall deliver all the services on or before December 1, 2026.
