Allegation(s)

The Parents alleges that the District failed to provide the Student language/communication services identified in his Individualized Education Program (IEP) due to staff vacancies (34 CFR §§ 300.323(c)(2) and 300.17 and RCSA § 10-76d-1(a)(1)).

Conclusion(s)

The District has shown that it responded promptly to the SLP vacancy by posting the position, notifying affected families, reallocating current SLP staff as available, contracting with outside agencies, maintaining documentation of missed sessions, and providing ongoing communication about the staffing shortage.

However, the District is still required to provide all special education and related services in the Student’s IEP. Because the District did not deliver all required language and communication services, it is in violation of 34 CFR §§ 300.323(c)(2) and 300.17, as well as RCSA § 10-76d-1(a)(1).

Given the documented efforts to address the vacancy, limited corrective action will be required.

Corrective Action(s)

  1. The District must continue to maintain an accurate log of all language and communication services scheduled for the Student. The service log must include the date of each session and indicate whether the service was provided. If a service is not provided, the log must document the reason it was missed. On or before November 1, 2026, the District must submit a copy of the completed service log to the Connecticut State Department of Education (CSDE) as evidence of the services delivered to the Student.
  2. The District must provide the Student with compensatory education to address the missed language and communication services. These services must be designed to support the Student in overcoming any gaps caused by the missed instruction and to promote continued progress. The District must provide the Student with one hour of individual language and communication services, and two hours of group language and communication services. If the District and the Parents are unable to agree on the scheduling of compensatory services, the District must contact this office, and the assigned investigator will make a final determination. The Parents may decline all or part of the compensatory education offered. The District must complete delivery of all compensatory services on or before December 1, 2026.
