Allegation(s)

The Attorney alleged that the District failed to fulfill written requests for educational records, noting that although special education records were provided, the District did not supply the Student’s full educational record. (RCSA) § 10-76d-18)

Conclusion(s)

In accordance with the Regulations of Connecticut State Agencies (RCSA) § 10-76d-18 parents are entitled to inspect, review, and receive one free copy of any educational records relating to their child that are collected, maintained, or used by the board of education. As specified in RSCA § 10-76d-18 (a)(2), upon receiving a written request, the board of education must comply with such request without unnecessary delay and before any meeting regarding an IEP, otherwise not later than ten (10) school days of such request.

In this case, although the District responded to the request made on June 30, 2026, and provided special education records on the same date, the copy provided was incomplete. On August 5, 2026, the District sent the Attorney additional records; however, these additional records still did not contain the full set of records requested by the Attorney. Therefore, the District violated RCSA § 10-76d-18 when it did not provide the Attorney with a full and complete copy of the Student’s educational records within the mandated timeline.

Although the District has proactively implemented changes to their records request process, corrective actions are still required.

Corrective Action(s)

  1. The District must supply all educational records requested. Any records that were not previously provided including State Test Results, Nursing Record(s), Student Success Plans, and/or Progress Monitoring Data, must be identified and submitted. A complete list of missing records should be compiled and included in the corrective action response. If any of the aforementioned records are not provided, the District must provide a rationale for why they were not provided. This response is to be sent to this investigator no later than ten school days from the date of this Findings Letter.
  2. The District must provide documentation of its revised system for fulfilling records requests, including the procedures for responding to written requests submitted outside the District’s electronic portal. This documentation must include:
    1. A detailed description of the District’s electronic portal workflow, including steps from submission to fulfillment,
    2. An explanation of backup roles including responsibilities assigned to each role, and
    3. A description of secondary monitoring structure and methods to ensure fulfillment within statutory timelines.

A description of the system is to be sent to this investigator no later than December 1, 2026.
