Allegation(s)
The Advocate alleged that the Student was not being provided the direct English/Language Arts (ELA) instruction in site 2a in accordance with his IEP and instead was placed in a general education ELA class with no special education teacher support. (34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1))
Conclusion(s)
34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1) require each board of education to provide in a timely way special education and related services in accordance with the student’s IEP.
The Student is being provided direct ELA instruction in accordance with his IEP during his period 8.3 class which meets every day in the Learning Center (site 2a/resource setting) as well as one additional day per week during his period 8.5 class in the Learning Center (site 2a/resource setting). While the Student is also attending a regular education ELA class during his period 8.5 class three days per week, his participation in that class is not scheduled to replace any of the direct ELA instruction in site 2a in accordance with his IEP. Therefore, the District is not in violation of 34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1). No corrective action is required.
