Allegation(s)
- The Guardian alleges that the District failed to provide the study skills instruction in accordance with the Student’s IEP during the 2025-26 school year. More specifically, she alleges that the special education teacher failed to provide specialized instruction to the Student aligned to the goals and objectives in his IEP. (34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3)).
Conclusion(s)
The issue is whether the District failed to provide the study skills instruction in accordance with the Student’s IEP during the 2025-26 school year, and whether the special education teacher failed to provide specialized instruction to the Student aligned to the goals and objectives in his IEP. 34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3) require each board of education to provide in a timely way special education and related services in accordance with the student’s IEP. Even though the teacher was absent for five days, it is unclear whether the Student received instruction on these days from another teacher, or if this time was made up at another time. Even without access to this information, it is clear that these absences were not material, and that the Student made appropriate progress on the goals and objectives in his IEP and received passing grades in all of his classes. A review of the study skills data and the progress reporting notes show that the teacher provided specialized instruction aligned with the goals and objectives in the Student’s IEP. Based on these reasons, no violation of 34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3) is found.
