Issue: The Parent alleged that the District’s refusal to evaluate denies the Student the right to FAPE. (34 CFR § 300.304(c)(6) and RCSA § 10-76d-7)
Conclusion(s):
It was established that the District received and responded to the Parents’ referrals according to regulatory requirements. Based on the facts related to both referrals to special education and subsequent PPT meetings, the facts support, and this investigator concurs, that the District explored all areas presented by the referrals as areas of concern and did not have reason to suspect that the Student had a disability and, therefore, had no obligation to move forward with an evaluation to determine eligibility for special education and related services. It was concluded that the District did not violate either 34 CFR § 300.304(c)(6) or RCSA § 10-76d-7. No corrective actions are issued.
