Issue 1: The Parents alleged that at a PPT meeting held on March 31, 2026, the District refused the Parents’ request for continued one-to-one reading instruction for the 2026-2027 school year and revised the Student’s instructional service delivery from one-to-one to small group, without data supporting the change in recommendation.
Conclusion(s)
Prior Written Notice (PWN) for the PPT meeting held on March 31, 2026, documented the evaluation procedures, assessments, records, or written reports used by the PPT as the basis for the proposed reading services for the 2026-2027 school year. A review of the Student’s progress reports on IEP goals and objectives indicated that the Student made satisfactory progress throughout the school year and mastered his IEP goals and objectives identified for the Student’s reading instruction by his annual review PPT meeting on March 31, 2026. Progress monitoring data for the 2025-2026 school year showed substantial improvement in decoding and encoding with fluency as a continued area of need. The Student’s report card indicated that he was meeting grade level standards in ELA for some and most learning objectives. While Parent concerns were noted, the current service provider for the Student’s reading instruction reported that the recommendation was based on the Student’s progress and continued areas of need and was an appropriate recommendation. Although the Student’s reading instruction for the 2026-2027 school year was decreased from sixty minutes daily one-to-one to 48 minutes of academic skills instruction daily in a small group with three of those days per week focused on decoding, fluency, and comprehension, the District also recommended adding 24 minutes four times per five-day cycle of site 1a instruction in the classroom focusing on his reading and writing goal. While it is noted that the Student received one-to-one reading instruction throughout the 2025-2026 school year, his IEPs indicated that the instructional services delivery was small group.
The District is not in violation 34 CFR 300.324(a) as there is evidence to support that the District considered the Student’s strengths, concerns, progress, and evaluation data when proposing the recommended reading services for the 2026-2027 school year. No corrective action is required.
