Allegation(s):
- Failure to provide special education and related services in conformity with an individualized education program (IEP) (34 CFR § 300.17(d))
Conclusion(s):
- The Student’s IEP includes the related service of language and communication group: 6x per month for 30 minutes for the timeline of March 2025, to the end of the 2024-2025 school year. The District indicated that there was a lapse in the related service of the language and communication group from March 19, 2025, to May 12, 2025, due to a vacancy. Because the District did not provide the Student with the language and communication group in accordance with the Student’s IEP, the District is in violation of 34 CFR § 300.17(d). Corrective action is required.
- For the timeline of April 25, 2025, to the end of the 2024-2025 school year, the Student’s IEP includes the related service of counseling group for 1x per month for 30 minutes. The District indicated that counseling was not provided to the Student in April 2025 or May 2025. The District indicated that three counseling sessions were provided to the Student in June 2025 (June 5, June 6, and June 11). The District indicated that two of those sessions were provided to the Student to make up for the counseling services that were not provided in April 2025 and May 2025. The District is in violation of 34 CFR § 300.17(d) for not providing the Student with the counseling group for the month of April 2025 and May 2025. The District made up this service by providing 2 extra counseling sessions to the Student in June 2025. No corrective action is required.
- In accordance with the Student’s current IEP, the District was required to provide the accommodation of “electronic communication log with parents” in the area of “resource/related services room”. The District confirmed that the Parents were not provided with the electronic communication log from the time period of March 14, 2025, to June 5, 2025. Because the District did not provide this accommodation in accordance with the Student’s IEP, the District is in violation of 34 CFR § 300.17(d). Corrective action is required.
Corrective Action(s):
- On or before October 31, 2025, the District must develop a compensatory service plan to provide the Student with 6 hours of speech and language services that were not provided during the timeline of March 19, 2025, to May 12, 2025. The full measure of missed services must be delivered to the Student no later than January 31, 2026. Immediately upon delivery of the Student’s full measure of compensatory services, the District shall inform the CSDE.
- On or before September 30, 2025, the District must meet with the Student’s school team and review the accommodations on the Student’s IEP.
- After the review occurs, the District must send an attestation of the review to the CSDE as evidence that the review has occurred. The attestation must include the names, roles, and signatures of the individuals who have reviewed the accommodations on the Student’s IEP.
