Allegation(s):

  • The Parent alleged that the District has failed to provide the Student with the special education services his IEP since October 24, 2025.  (34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1))

Conclusion(s):

  • 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1) require each board of education to provide in a timely way special education and related services in accordance with the student’s individualized education program.  From October 24, 2025 through November 25, 2025, the District failed to provide the Student with the services in his IEP, while he was attending LINKS Academy.  During this time approximately four weeks elapsed.  Therefore, the District violated 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1) during these four weeks.  Corrective action is required, see below.  After the PPT revised the Student’s IEP on November 25, 2026, the District fully implemented the Student’s IEP, except for the speech and language services.  

Corrective Action(s):

  • The District must provide the Student with a total of 2.5 hours of compensatory individual counseling services.  Documentation that these services were delivered must be sent to this office.  Given that the Student was receiving tutoring during this time in four different subjects and earned credits for each subject area, the District is not required to provide any compensatory education for the reading, writing, math, and academic skills push-in services.  The District has represented that it has created a compensatory education plan for the missed speech and language services.  Therefore, no additional compensatory education is warranted at this time.  Documentation of the plan and that the services were delivered must also be sent to this office.
