Allegation(s):

  • 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1) failure to provide, in a timely way, special education and related services in accordance with the student’s individualized education program.

Conclusion(s):

  • The District is obligated to provide the Student with all special education and related services listed in the IEP, but they failed to provide language/communication services and therefore they are in violation of 34 CFR §§ 300.323(c)(2) and 300.17, and RCSA § 10-76d-1(a)(1).

Corrective Action(s):

  • The District is required to provide compensatory language/communication services in the amount of 120 minutes to address the missed services as of the filing of this complaint. Additionally, compensatory language/communication services are to be provided for any sessions missed after this complaint was filed, until the vacancy is filled. The provision of compensatory services shall occur under terms mutually agreed upon by the Parents and the District. If the District and the Parents encounter a disagreement about the scheduling of services, the District shall contact this office and this investigator will decide. The Parents may decline the offer of compensatory education in whole or in part.
  • The District must maintain a monthly log for the remainder of the school year to document the Student’s language/communication services in accordance with the Student’s IEP. Each month’s completed log must be submitted.
  • The District must continue their efforts to hire an SLP to implement IEPs as written. The District must provide monthly updates on their recruitment efforts until an individual has been hired to fill the SLP vacancy. Each month’s update must be submitted.
