Allegation(s)

The Parent alleges that the District failed to provide Extended School Year (ESY) services during the summer of 2025 as outlined within the Student's IEP. (34 CFR §§ 300.106(a)(1), 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1))

Conclusion(s)

The District should have reconvened a PPT meeting as the ESY services in Student's IEP (findings of fact #8) were inconsistent with the District's plan to provide five hours of tutoring per week. Additionally, the 17 hours of tutoring provided in August 2025 cannot be counted toward the District's ESY obligation because they were already included in the compensatory education calculation for state complaint #25-0598 and because the tutoring provided did not match the special education and related services as written in the Student's IEP. Therefore, the District did not provide ESY services during the summer of 2025 and is in violation of 34 CFR §§ 300.106(a)(1), 300.323(c)(2), and 300.17, and RCSA § 10-76d-1(a)(1), Corrective action will follow.

Corrective Action(s)

  • The District must provide the Student with the following compensatory education to make up for the ESY summer services missed:
    1. Academic Skills: 960 minutes
    2. Language/Communication (individual): 120 minutes
    3. Fine Motor Skills (individual): 120 minutes
    4. Language/Communication (group): 120 minutes
    5. Counseling (group): 120 minutes
    6. Fine Motor Skills (individual): 120 minutes
    7. Counseling (individual): 120 minutes

This provision aims to ensure that the Student receives the necessary support to address any gaps in his education and to facilitate his continued progress and development. If the District and the Parent encounter a disagreement about the scheduling of services, the District shall contact this office and the investigator will decide. The Parent is free to decline the offer of compensatory education in whole or in part. The District shall provide this office with monthly reports documenting the delivery of these services.

  • The District must provide training to all PPT members who are District staff on the legal requirements involved in determining and documenting ESY services to include the revision of IEPs when necessary. Included in the content of this training should be a review of Chapter 5 of the Special Education Procedures and Practices Manual (Individualized Education Program). This training may be incorporated into regular staff professional development. An agenda for the training, along with a list of attendees, must be submitted to this office..
