Allegation(s):
Issue: The Parent alleged that the Student was not provided with any IEP services during a time of hospitalization (i.e., December 9, 2024, through January 29, 2025). The Parent indicated that this issue was not addressed during the aforementioned due process hearing, therefore, this issue was investigated. (RCSA § 10-76d-15)
Conclusion(s):
While the Student experienced the initial hospitalization at [Hospital] (for 5 days), the District was not notified by the Parent, APSEP, or the treating physician, that the Student was hospitalized. However, once the Student was transferred to [Hospital] on December 17, 2024, the District received notification and appropriate documentation of the Student’s need for hospital instruction. Based on December 17, 2024, as the start date of the required 10 days of consecutive school days prior to beginning to provide services, and the holiday schedule for the APSEP, January 9, 2025, was the date on which the District was to begin providing services to the Student in the hospital setting, which they did through from January 9, 2025, through January 29, 2025. The District ensured that educational services were provided to the Student during all of the time (sans holiday break and 3 days during which the Student was unable to participate) that the Parent alleged such services had not been provided. It was concluded that the District was not out of compliance with 34 CFR § 300.17(d) or RCSA § 10-76d-15. No corrective actions were issued.
