Allegation(s):

  • CFR § 300.321(a)(4) failure to ensure that the PPT team for each child with a disability includes a representative of the public agency (i) is qualified to provide, or supervise the provision of, specially designed instruction to meet the unique needs of children with disabilities; (ii) is knowledgeable about the general education curriculum; and (iii) is knowledgeable about the availability of resources of the public agency.

Conclusion(s):

  • While a District Administrator attended the PPT meeting, they did not have the requisite authority for decision-making regarding resources of the public agency. Therefore, the District is in violation of 34 CFR § 300.321(a)(4).

Corrective Action(s):

  • The District is to provide training to all administrators on legal requirements for PPT membership.
