The Parent claims that the Student was publicly reprimanded by two administrators on June 4, 2025, in the cafeteria. (34 CFR § 300.42)

Conclusion(s)

In this case, an accommodation to avoid public reprimand existed on the Student’s IEP. An incident occurred on June 3, 2025, in the cafeteria. An administrator attempted to speak to the Student when others were not around on June 4, 2025. However, the Student asked questions and refused to follow the administrator’s directives. The Student refused to relocate and remained engaged in the conversation. Despite the Student’s behavior, the administrator did not publicly reprimand the Student and implemented the accommodations in the Student’s IEP. Therefore, the District is not in violation of 34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3) or 34 CFR § 300.42. No Corrective Action is required.
