  • The Parent alleges that since the start of the school year the District has not educated the Student in the least restrictive environment. (34 CFR §§114-118)

Conclusion(s)

  • In this case, the Student transitioned into the District at the beginning of the school year. The District replicated the IEP that the Student had from his previous District. Upon getting to know the Student better, the District created a structured fade in plan to increase the Student’s hours with his non-disabled peers. In October, the Student was spending approximately 20% of time with non-disabled peers. In May, the amount of time had increased to 34%. For that reason, there is no violation of 34 CFR §§114-118. No corrective action required.
