Allegation(s)

The Parent alleged that the District is in violation of Child Find due to their refusal to evaluate the Student at a planning and placement team (PPT) meeting on March 30, 2026. (34 CFR §§ 300.111 and 300.304(c)(6) and RCSA §§ 10-76d-6 and 10-76d-7(c))

Conclusion(s)

The District and Parent may disagree about the basis for the Student’s referral for special education and related services; however, the District convened a PPT meeting in accordance with its Child Find obligations. During the March 30, 2026 meeting, the team reviewed a variety of academic and behavioral data, along with input from teachers and the Parent. The PWN outlines the District’s reasoning and demonstrates that the PPT had sufficient evidence at that time to not suspect a disability since the Student was performing at or above grade-level expectations, did not require individualized instruction, and was appropriately supported through a Section 504 plan. Therefore, the District is not in violation of 34 CFR § 300.111, RCSA §§ 10-76d-6 and 10-76d-7(c).
