- The Parent alleged that the District will not let her view a video of an incident which occurred with the Student in school on April 23, 2026. (RCSA § 10-76d-18)
Conclusion(s)
Regulations of Connecticut State Agencies (RCSA) § 10-76d-18 provides each board of education shall maintain records concerning children with disabilities or children referred for an evaluation to determine the child’s eligibility for special education and related services. Parents have the right to inspect and review any education records relating to their child which are collected, maintained, or used by the board of education. The parent’s right to inspect and review their child’s records includes the right to one free copy of those records. If a written request for the free copy is made, the board of education must comply with the request not later than 10 days of the request. According to RCSA Section 10-76a-1(5), “days” means school days unless otherwise specified. Education records are records directly related to the student and maintained by the educational agency. In this case, the District did not “maintain” the video because it did not show any footage of the incident. The video was only maintained because the Parent requested it. Since the video was not maintained by the District it does not meet the definition of an education record and did not have to be provided to the Parent, and thus the District did not violate RCSA § 10-76d-18. Even if the video was considered an education record, when education records contain information on more than one student, the parent may inspect and review or “be informed of” only the specific information about his or her own child, unless the information about the other student or students cannot be segregated and redacted without destroying its meaning. In this case, the video shows numerous other students, since it contained footage of students walking in the halls while classes were in session and then footage of students leaving their classes once the classes ended. The Parent was informed of what was in the video that related to the Student. (Finding of Fact #3). Furthermore, given the number of other students in the video, it could not be segregated and redacted without destroying its meaning.
