Allegation(s)
Issue 1: The Surrogate Parent alleged that the Occupational Therapy (OT) and Speech and Language (SL) consultation services required by the Student’s IEP, dated April 21, 2025, at a rate of 20 minutes per month each for OT and SL, were not provided. (34 CFR § 300.17(d))
Issue 2: The Surrogate Parent indicated that she had not been provided with a copy of the Student’s April 21, 2025, IEP within the required timeline. (RCSA § 10-76d-13(a)(6))
Conclusion(s)
As related to Issue 1, based on missed OT and SL consultations in May 2025, June 2025, September 2025, October 2025, and November 2025, the total missed OT consultation time is 20 minutes per month for 5 months or 100 minutes and total missed SL consultation time is 20 minutes per month for 5 months or 100 minutes. The District owed these consultation times to the Student. It was concluded that the District was not in compliance with 34 CFR § 300.17(d) and corrective actions were issued.
As related to Issue 2, the District did not provide the Surrogate Parent with the Student’s April 21, 2025, IEP within five days of the PPT meeting. The District was out of compliance with RCSA § 10-76d-13(a)(6). Based on this issue of non-compliance, this investigator would have issued a corrective action related to setting in place a system to ensure that drafts of documents do not remain in CT-SEDS without proper finalization, however the District proactively initiated and completed that task. Therefore, no corrective actions were issued.
Corrective Action(s)
- The District shall provide the missed 100 minutes of OT consultation time and 100 minutes of SL consultation time.
- Upon providing the full measure of all missed services, the District shall inform the State.
