Allegation(s):
- Failure to ensure that assistive technology devices or assistive technology services, or both, are made available to a child with a disability if required as a part of the child’s special education, related services, and/or supplementary aids and services (34 CFR § 300.105)
- Failure to provide prior written notice to the parents of a child with a disability when the district either proposes or refuses to initiate or change the identification, evaluation, or educational placement of the child or the provision of a free and appropriate public education (FAPE) to the child (34 CFR § 300.503)
Conclusion(s):
- The Parent emailed the District requesting to utilize the AngelSense device as a GPS tracking system. The District emailed the Parent approving the AngelSense device to be only used as a GPS tracking system. The District also emailed the Parent stating that the use of the AngelSense device was approved if used in adherence with the Board’s policy.
- A review of the Student’s incidents of elopement was reviewed for this investigation. As evidenced by the Student’s behavior log, the Student did not exhibit any instances of elopement for a specified timeline. The logs also indicate that the Student successfully transitioned for 100% of the specified timeline. The Parent reported two incidences of elopement. For both of these instances, there was not an imminent danger to the Student, as the Student appeared safe, in close proximity to adults, and far enough away from the driveway.
- The Student’s progress on IEP goals and objectives related to behavior was also reviewed. This review shows that the Student made appropriate progress on all three objectives associated with behavior. The Student did not have IEP goals or objectives associated with behavior for IEPs for the 2025-2026 school year.
- For the reasons of the District’s approval of the use of the AngelSense device as a GPS tracking system, the Student’s limited instances of elopement in the school environment, the Student’s behavior tracking log indicating no instances of elopement, and the Student’s progress on IEP goals and objectives related to behavior, the District was not obligated to consider the AngelSense device as an assistive technology device or service, as it is not required as part of the Student’s IEP at this time. Additionally, the Parent never requested the use of the Angel Sense in a PPT meeting. The District is not in violation of 34 CFR § 300.105. No further action is required.
- The District did not refuse the use of the AngelSense device for GPS tracking in a PPT meeting, so a Prior Written Notice was not required to be provided to the Parent. The District is not in violation of 34 CFR § 300.503. No corrective action is required.
