Allegation(s)
The Parent alleges that the District has failed to provide speech and language services, as required in the Student’s IEP, since the start of the school year on August 25, 2025. (34 CFR §§ 300.323(c)(2), 300.17, and RCSA § 10-76d-1(a)(1)).
Conclusion(s)
The District has provided the Student with all individual language/communication services as required plus an extra 240 minutes, but they failed to deliver 690 minutes of group language/communication services. As a result, the District is in violation of 34 CFR §§ 300.323(c)(2) and 300.17, and RCSA § 10-76d-1(a)(1). Corrective actions are required.
The District has maintained a log of the missed services and has communicated with the Parent regarding the shortfall. A compensatory services plan totaling 300 minutes (5.5 hours) has been agreed upon, resulting in 120 minutes of language/communication services still outstanding.
Corrective Action(s)
- The District is to provide the Student with 120 minutes of compensatory Language/Communication services. The District can utilize District staff or contract with an agency.
- If the District and the Parent encounter a disagreement regarding the scheduling of services, the District shall contact this office, and the investigator will make a determination.
- The Parent is free to decline the offer of compensatory services in whole or in part.
- The District shall deliver all of these services on or before September 15, 2026.
