Allegation(s)
The Parent alleged that the District failed to provide an appropriate program for the Student during this school year. (34 CFR §§ 300.324(a)(1), 300.324(a)(2)(i), and 300.320(a))
Conclusion(s)
Despite the District’s recognition that engagement and attendance were significant problems, and despite reconvening for a PPT meeting on November 21, 2025, where modified days were offered, no revisions were made to the Student’s IEP. Although the District proposed targeted assessments at that meeting, these were limited to cognitive functioning and academic achievement and did not address behavior or the underlying causes of the Student’s school avoidance. At the annual review on January 9, 2026, the District proceeded with a more restrictive option by recommending that 1:1 tutoring occur at a location outside of the school; which was not accurately documented within the IEP services or TWNDP. Additionally, the Student made zero or negligible progress across IEP objectives and earned no credits for at least the first half of the school year. As the District failed to revise the Student’s IEP to incorporate positive behavioral interventions and supports, and did not propose and conduct informal or formal assessments and evaluations necessary to develop an IEP that would enable the Student to make progress on their goals, objectives, or within the general education curriculum, the District is in violation of 34 CFR §§ 300.324(a)(1), 300.324(a)(2)(i), and 300.320(a). Corrective action will follow.
Corrective Action(s)
The District must convene a PPT meeting no later than September 15, 2026, for the following purposes: a) Explore underlying causes of school refusal and consider if additional information is needed for developing the IEP and commission targeted assessments (to include an FBA, and if warranted, a consequent Behavior Intervention Plan); b) Revise the IEP to accurately reflect current performance, needs and services: present levels of performance, goals, objectives, and supplementary aids and services, special education and related services, and removal from the general education environment.
