Allegation(s):
- The Parent alleged that the District did not provide the Notice of PPT meeting five days prior to the PPT meeting held on October 7, 2025. RCSA § 10-76d-12(a)(1)
Conclusion(s):
- The District advised the Parent in writing of her rights to be a participating member of the planning and placement team four days prior to the PPT meeting scheduled for October 7, 2025. Therefore, the District was in violation of RCSA § 10-76d-12(a)(1). The District’s position that the Parent agreed on October 2, 2025, to attend the PPT meeting on October 7, 2025, despite not receiving notice five days prior to the scheduled PPT meeting, should have then resulted in the District obtaining the Parent’s consent to waive their right to five-day notice which is not documented in the Student’s file. Corrective action is required.
Corrective Action(s):
- The District must review the required timeline of RCSA § 10-76d-12(a)(1) with the staff responsible for providing the PPT Notice of Meeting to the Parents for the PPT meeting held on October 7, 2025. The content of the review and staff signature(s) and date must be sent to this investigator on or before January 9, 2026.
