Allegation(s):
- The Parent alleged that the special education teacher providing the Student with her reading instruction in accordance with her IEP is not trained in evidence-based structured reading. The Parent further alleged that the Student was not provided with the accommodation of alternate location for tests/quizzes for a biology quiz on September 22, 2025. 34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1)

The special education teachers assigned to provide the Student with her reading instruction in accordance with her IEPs for the 2024-2025 and 2025-2026 school years held/hold active certifications as special education teachers in Connecticut. For the 2024-2025 and 2025-2026 school years, the responsible staff and service implementers identified for the Student’s reading instruction in her IEPs were special education teachers (site 2a) as well as paraeducator and general education teachers (site 1a). Therefore, the District was in compliance with 34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1). No corrective action is required.

The Student was not provided with the accommodation of alternate location for tests/quizzes on September 22, 2025, when the Student took a Biology quiz. Therefore, the District was in violation of 34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1) for failure to implement the accommodation. Prior to the issuance of this findings letter, the District created a plan for the Student’s alternate location for tests/quizzes which was shared with all teachers working with the Student. Therefore, while the District was in non-compliance, they have established a plan for compliance and no further corrective action is required.
