Allegation(s):

  • The Parent alleged that the District failed to provide the Student with paraeducator support in social studies class in accordance with her IEP on August 28, 2024, August 30, 2024, September 4, 2024, and September 6, 2024. The Parent further alleged that the Student was not provided with the accommodation of alternate location for tests/quizzes on the following dates: September 4, 2024, October 28, 2024, January 21, 2025, February 21, 2025, and September 8, 2025. The Parent also alleged that the Student was not provided with testing accommodations, including questions read aloud, in accordance with her IEP. 34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(1)

Conclusion(s):

  • The Student began the 2024-2025 school year without the 30 minutes of paraeducator support in social studies for a total of 4 classes. As of the third week of school, the District assigned a paraeducator to provide the Student support in her social studies classroom. The paraeducator’s schedule confirms the District’s statement that the Student was provided support for the entire 82 minutes of her social studies class which was more than the 30 minutes of support provided by her IEP. Therefore, while the District was in violation of 34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1) for the first four social studies classes of the 2024-2025 school year, they took action to correct the violation. No corrective action is required. While the Student’s final grades are satisfactory, the Student’s accommodation is for an alternate location for tests/quizzes in all areas. The Student retaking her tests/quizzes is not the same as providing the Student with an alternate location for the test/quiz at the time of the assessment. With regards to the exit slip on September 8, 2025, this investigator agrees with the District’s position that an exit slip is not a test/quiz and therefore the accommodation of alternate location for tests/quizzes in all areas was not applicable. The Parent’s allegation that the Student was not provided the accommodation of assessment questions read aloud is not supported by the Student’s accommodations within her IEP. Based on the information available for the dates of the test/quizzes investigated in this complaint, it is determined that the District was in violation of 34 CFR §§ 300.323(c)(2) and 300.17(d) and RCSA § 10-76d-1(a)(1) as it relates to the District’s implementation of the Student’s accommodation of alternate location for tests/quizzes in all areas. Corrective action is required. Also, see a recommendation below.

Corrective Action(s):

  • The District must provide training to the Student’s team from the 2024-2025 and 2025-2026 school years on the implementation of alternate location for test/quizzes as well as identifying back up options when the primary plan is not able to be implemented. Clarity on the use of retaking assessments as a separate accommodation from the accommodation of alternate location for tests/quizzes must be included in the training. An overview of the training with staff signatures and date must be sent to this investigator on or before November 17, 2025. 
  • Recommendations: It is strongly recommended that the District create a plan for the Student to take tests/quizzes in an alternate location in all areas for the 2025-2026 school year. This should include the plan for each academic content area as well as a back-up plan if the first option is not available for any given test/quiz.
