Allegation(s):

  • The Parent alleged that the District has failed to provide the Student with a 1:1 paraprofessional, as documented in the Student's IEP, since the start of the 2025-26 school year. 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1) require each board of education to provide in a timely way special education and related services in accordance with the student's individualized education program.

Conclusion(s):

  • 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1) require each board of education to provide in a timely way special education and related services in accordance with the student's individualized education program. The Student's current IEP states under accommodations, "1:1 paraeducator support throughout the day, in all classes, to work on behavior intervention plan with gradual fading support over time." The documentation reviewed as part of this investigation shows that the District failed to provide a paraeducator for the Student, in accordance with his IEP, on September 23, 2025, September 24, 2025, September 25, 2025, October 6, 2025, October 7, 2025, and October 21, 2025. Thus, a violation of 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1) is found. Corrective action is required, see below.

Corrective Action(s):

  • For the remainder of the 2025-26 school year, the District must send this office monthly logs documenting the implementation of the paraeducator support in the Student's IEP. 
  •  On or before January 31, 2026, the District must convene a PPT meeting to create a plan for days when the Student's paraeducator is absent. The PPT must carefully consider that the IEP provides for a paraeducator who is to assist the Student with his behavior intervention plan. The PPT must also consider the fact that at the start of this school year, the Student transitioned from a more restrictive placement and therefore the fading of the paraeducator must be implemented according to an intentional, data-based plan.
