Allegation(s):
- The Attorneys allege that the Student has not been provided the special education services in compliance with their individualized education program (IEP) since August 26, 2025, due to the Charter not having a special education teacher. (34 CFR §§ 300.323(c)(2), 300.17, RCSA § 10-76d-1(a)(1), and Conn. Gen. Stat. § 10-66ee).
Conclusion(s):
- The BSE understands the challenges in hiring highly qualified staff and consequently, that instances arise when IEP services cannot be fully delivered due to staffing vacancies. Additionally, the Charter is recognized for its transparent communication of these challenges to both the Parent and the District, and the District is recognized for convening PPTs to discuss these challenges. It is the Charter’s responsibility for ensuring that services are provided as mandated by the Student’s IEP, but these services may be provided directly by the Charter or in cooperation with the District. As the reading and writing services required per the Student’s IEP were not provided, both the Charter and the District are in violation of 34 CFR §§ 300.323(c)(2), 300.17, RCSA § 10-76d-1(a)(1), and Conn. Gen. Stat. § 10-66ee. Corrective action will follow.
Corrective Action(s):
- The District and the Charter will coordinate to provide the Student with compensatory education to make up for the time missed in the areas of reading and writing. The total number of minutes awarded for this compensatory education is 8,928 minutes: 5,952 minutes for reading instruction and 2,976 minutes for writing. This provision aims to ensure that the Student receives the necessary support to address any gaps in his education and to facilitate his continued progress and development. The provision of compensatory education shall occur under terms mutually agreed upon by the Parent, the Charter, and the District. If the District, the Charter, and the Parent encounter a disagreement about the scheduling of services, the Charter and the District shall contact this office and this investigator will decide. The Parent may decline the offer of compensatory education in whole or in part. The Charter and the District shall provide this office with monthly reports documenting the delivery of these services. The District shall deliver all the services on or before December 1, 2026.
