Allegations:
Issue 1: The complainant alleged that the members of the PPT meeting left the meeting without notifying the Parent and Advocate, prior to the end of the PPT meeting. (34 CFR § 300.321)
Issue 2: The complainant alleged that members of the PPT stated that they could not propose goals and objectives after the Student was found eligible for special education and related services as they did not know the Student. (34 CFR § 300.320(a))
Conclusions:
Issue 1: The PPT meeting included all required members of the PPT with additional staff members attending for many of the required roles. The general education teacher and school social worker leaving the meeting for approximately two minutes and then logging back on does not violate 34 CFR § 300.321. They did not leave the meeting altogether as the Advocate and Parent originally alleged. The staff members left the PPT meeting and rejoined on their cell phones, at approximately the two-and-a-half-hour mark of the PPT meeting. It is not unreasonable to assume that staff may require a short break after being in a PPT meeting from 11am-1:30pm, especially when the PPT meeting was originally scheduled for one hour and the Parent and Advocate refused to break or reconvene. The District is not in violation of 34 CFR § 300.321. No corrective action is required.
Issue 2: A review of the Student’s psychoeducational evaluation and social work assessment confirmed that information from the evaluations were used to draft the statements of the Student’s present levels of performance. Information from the present levels of performance was then used to draft the goals and objectives in the goal areas of Other (Academics), Behavior, and Social/Emotional. It is therefore determined that the District and Charter School did not violate 34 CFR § 300.320(a) as the assessment data informed the present levels of performance which informed the measurable annual goals. No corrective action is required.
