Allegation(s)

The Parent alleged that the District failed to timely evaluate the Student in seventh grade when the Student’s grades were declining and at the Parent’s request. Please note that due to the one year look back period the time frame relevant for this complaint is May 21, 2025, through May 21, 2026. (34 CFR § 300.111 and RCSA § 10-76d-7)

Conclusion(s)

34 CFR § 300.111 requires that all children with disabilities residing in the State who are in need of special education and related services be identified, located and evaluated.  RCSA § 10-76d-7 requires prompt referral to a PPT of all children who have been suspended repeatedly or whose behavior, attendance or progress in school is considered unsatisfactory or at a marginal level of acceptance. There is no evidence that the Parent made a special education evaluation during the relevant time period of this investigation. Additionally, during this time period, the Student’s progress in school was satisfactory. Therefore, no violation of 34 CFR § 300.111 or RCSA § 10-76d-7 is found.
