Allegation(s):
- The Complainants allege that the three Students all have individualized education programs (IEPs) that entitle them to a full day of special education, along with related services such as speech and language services and occupational therapy services.However, the District failed to provide the services as required by IDEA, and corresponding state laws and regulations.(34 CFR §§ 300.323(c)(2) and 300.17 and RCSA § 10-76d-1(a)(1))
Conclusions
- Regarding Student #1 - he did not have an IEP that was in effect.Rather, the District endeavored to adhere to 34 CFR § 300.323 (c) and to provide special education and related services as soon as possible.
- Regarding Student 2 - the Parent decided to place the Student at a charter school.The District was not made aware by either the charter school or the Parent when the Parent decided to withdraw the Student from the charter school at the end of August 2025.District staff were made aware that the Student was not placed any longer the charter school when they were contacted by the Attorney representing the Student on September 17, 2025.The District quickly responded by enrolling the Student in a magnet school to meet her needs.
- Regarding Student 3- the Student was evaluated and found eligible for special education and related services in 2022.The District attempted to have the Parent sign written consent for the implementation of services, however it did not occur.Additionally, the Parent did not complete the registration process in the summer of 2022.When the Student was enrolled in 2025, she was immediately evaluated and found eligible for special education and related services, and her IEP was implemented.
