Allegation(s):

Issue: The Parent alleged that certain IEP accommodations were not being implemented by the Student’s English Language Arts (ELA) and Math teachers and that, since the March 9, 2026, PPT meeting, the Student’s ELA teacher has discontinued implementing the Student’s IEP. The specific accommodations cited in the Parent’s allegations were orally read directions, shortened math sprints, and positive reinforcement. (34 CFR § 300.17(d) and 34 CFR § 300.101)

Conclusion(s):

As related to the implementation of the Student’s IEP accommodations, the District’s and the School’s responses contradicted each other.  As there was no verifiable way in which to determine which of the responses was accurate, the investigator was compelled to review the implementation of the Student’s IEP and the provision of FAPE as compared to the Student’s progress on IEP goals and objectives, since it is expected that appropriate progress would be the result of full implementation of the Student’s IEP, including accommodations. It was previously found that the Student’s March 2025, April 2025, and April 2026 IEP Goals and Objective Progress Reports all demonstrated that the Student continued to make satisfactory progress or achieved mastery on all introduced goals and objectives. Therefore, the Student’s IEP, was implemented, resulting in the provision of FAPE to the Student. It was concluded that the District did not violate either 34 CFR § 300.17(d) or 34 CFR § 300.101and no corrective actions were issued.
