Allegation(s):
- According to the Parent, an incident occurred on February 25, 2026.The District failed to implement the Student’s BIP with integrity which put the Student’s safety at risk. (34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3))
Conclusion(s):
- In this case, the four target behaviors addressed by the BIP were noncompliance/refusal, disruptive behaviors, elopement, and negative interactions.All staff working with the Student were required to be familiar with his BIP to ensure the plan was implemented with fidelity. The Staff were trained on the BIP and were informed when adjustments were made to the BIP.Behaviors were tracked daily, and the data was tracked by the Board Certified Behavior Analyst (BCBA) weekly.On February 25, 2026, the Student’s BIP was implemented with fidelity.The Student was in ISS, however, and still could not follow behavioral expectations.He was leaving the space without permission, using inappropriate language, and dropping beads from the balcony.As such, a District Administrator changed his In-School Suspension to an Out of School Suspension.This is not a violation of 34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3).No Corrective action is required.
