Allegation(s)
Issue 1: The Complainant alleges that on or around April of 2026, she was informed that the Student was not receiving the 1:1 paraprofessional services in accordance with his IEP. (34 CFR §§ 300.323(c)(2) and 300.17 and RCSA § 10-76d-1(a)(1)).
Issue 2: The Parent alleges that during the 2025-26 school year, the Student’s AAC device was not sent home on several occasions, which impacted his ability to communicate in the home environment. (34 CFR §§ 300.323(c)(2) and 300.17 and RCSA § 10-76d-1(a)(1)).
Conclusion(s)
Issue 1: The issue is whether the District implemented the Student’s 1:1 adult support during the 2025-26 school year in accordance with his IEP. The District does utilize several different staff members to provide adult support to the Student in accordance with his IEP. There is no evidence that the adult support was not provided to the Student during the 2025-26 school year. The school did not violate 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3) since it provided the Student with the adult support outlined in his IEP during the 2025-26 school year.
Issue 2: The District conceded that it failed to send home the Student’s AAC device on three occasions and thus violated 34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(3). The District has proactively taken several actions (i.e., dismissal checklist, retraining staff, and teaching the Student about bringing home the ACC device) to correct this violation. Therefore, no corrective action is required.
