Conclusion(s)

There is evidence that the District did not provide the Student with the service of academic/behavioral supports 1x per week for 550 minutes in site 1a in conformity with the Student’s IEP on four instances between January 2025 and February 2025. The District indicated that the service was not provided to the Student in these instances due to the absences of trained staff required to safely implement the Student’s services in the general education classroom. The District indicated that in the four instances that the Student did not receive the services in the general education classroom, the Student’s assigned paraeducator and the back-up paraeducator were absent. The District indicated that assigning an untrained paraeducator to the Student would have posed a significant safety risk. Because the Student was not provided with the service of academic/behavior support in the general education setting in accordance with the Student’s IEP, the District is in violation of 34 CFR § 300.17(d). Corrective action is required.

Corrective Action(s)

On or before March 1, 2026, in addition to the two paraeducators already trained in the Student’s safety plan, the District must provide training to one additional paraeducator to provide the service of academic/behavior supports to the Student in the general education classroom when the assigned paraeducator and back-up paraeducator are absent. No later than March 1, 2026, the District shall provide the CSDE with an attestation that the training has occurred, including the name of the paraeducator and the date of the training.

For March 2026 and April 2026, the District must track the Student’s academic/behavior supports service in the general education classroom to ensure the service is provided to the Student. The service log must include the date, and whether or not the Student was provided with the service. If the Student was not provided with the service, the service log must note the reason the service was not provided. On or before May 15, 2026, the District must submit a copy of the service log to the CSDE as evidence that the Student was provided with the service.
