Allegation(s):

  • The Parent alleged that the Parent made a written request for a complete copy of the Student’s educational records, but did not receive any of the data collected by the previous BCaBA and data collected by the speech and language pathologist that may have been used to write the Student’s IEP goals and objectives. RCSA § 10-76d-18(a)(1-2).
  • The Parent alleged that the Student’s IEP academic services were not being implemented since the onset of the 2025-2026 school year. The Parent alleged that some IEP related services were being improperly implemented during that same timeframe. 34 CFR § 300.17(d).

Conclusion(s):

  • It was concluded that all of the SLP data had been submitted to the Parent, but it could not be verified that any of the previous BCaBA data had been submitted. The District was found to be in violation for the BCaBA portion of the allegation.
  • It was concluded that the Student’s academic IEP services had not been provided and the District was found to be in violation. It was also concluded that the use of an AAC device by the Student was appropriately provided and the District was not in violation. It was further concluded that the Student’s BIP was revised without the appropriate data from the previous BCaBA and the Distirct was in violation.

Corrective Action(s):

  • The District was directed to contact the previous BCaBA and obtain an attestation from that BCaBA that either, a) all of the BCaBA’s records for the Student which are considered education records have been submitted as part of the Student’s education records, or b) that the BCaBA is unable to verify that all of the BCaBA’s records for the Student which are considered education records have been submitted as part of the Student’s education records. If the BCaBA identified that any additional education records of the Student, those records must be immediately obtained by the District and made part of the Student’s education record and those records must be provided to the Parent.

The District shall convene a PPT meeting:

  • To consider the Behavioral Summary (CT-SEDS document 22469 in the Student’s record) and any other newly identified BCaBA education records, if any, toward the review and revision of the Student’s BIP.
  • To develop a compensatory services plan to deliver missed Academic Skills services to the Student (aligned with the Student’s IEP) in the amount of:
    • 540 minutes of Site 1 instruction as of October 27, 2025, and
    • 780 minutes of Site 2 instruction as of October 27, 2025.
    • For Site 1 services, the District shall continue to track additional missed services until those services begin to be provided to the Student, at which time the balance of those missed services shall be added to the Student’s compensatory services plan.
    • For all services owed, services must be delivered in full no later than September 11, 2026. The District may collaborate with the School in the delivery of such services.
  • To consider the results of the Student’s expressive/receptive/pragmatic assessment completed by the speech and language pathologist.
