Allegation(s)
Issue: The Parent alleged that the Student's speech-language services and occupational therapy (OT) services were provided only one time during the week of June 1-5, 2026, which was not in compliance with the Student's IEP. (34 CFR § 300.17(d)).
Conclusion(s)
During the week of June 1-5, 2026, the Student was provided with OT services as required by his IEP. During that same week, the Student was not provided with speech and language services for 20 minutes per day for 20 minutes each time (totaling 100 minutes of speech and language services each week) as required by his IEP. Instead, to accommodate staff scheduling, the Student was provided with speech and language services on 2 of the 5 days that week for more than 20 minutes each time, totaling 75 minutes of service.
The Student did not receive, and was owed, 25 minutes of speech and language services. The District was out of compliance with the requirements of 34 CFR § 300.17(d). Corrective actions were issued.
Corrective Action(s)
- On or before October 15, 2026, the District shall provide the Student with 25 minutes of compensatory speech and language services. Upon full delivery of such services, the District shall notify the BSE.
