Allegation(s)
- The Parent alleged that the District agreed to fund an independent reading evaluation on or around January 2026. However, the District has not taken the necessary steps to fund the evaluation. (34 CFR § 300.502(2))
Conclusion(s)
34 CFR § 300.502(2) requires that if a parent requests an independent educational evaluation at public expense, the public agency must, without unnecessary delay, either— (i) File a due process complaint to request a hearing to show that its evaluation is appropriate; or (ii) Ensure that an independent educational evaluation is provided at public expense, unless the agency demonstrates in a hearing pursuant to §§ 300.507 through 300.513 that the evaluation obtained by the parent did not meet agency criteria. The District agreed to fund an IEE for the Parent on or around January 14, 2026. As of April 28, 2026, the District had not provided the evaluator with the release, provided the Parent with a consent form, responded to the Parent’s communications, or taken any further actions to ensure that an IEE was provided for the Parent. Therefore, the District is found in violation of 34 CFR § 300.502(2) for not funding an IEE for the Parent without unnecessary delay. Corrective action is required, please see below.
Corrective Action(s)
Since the complaint was filed, the District has initiated the process to fund an IEE for the Parent with a different evaluator chosen by the Parent. The District must send documentation to this office evidencing the steps it has taken to ensure that an IEE is funded for the Parent without unnecessary delay.
